Practice
Adam practises in all areas of commercial law, including agency, arbitration, banking, carriage of goods, conflict of laws, insurance and reinsurance, international trade, professional negligence, restitution, sale of goods, and shipping.
Experience
Since joining Chambers in 2009, Adam has acted for a broad range of clients in a variety of commercial disputes. He has gained particular experience in the following areas.
General Commercial Litigation
- Instructed by an English company in a dispute relating to loan and shareholders agreements. As a junior to Tim Kenefick, Adam advised, settled pleadings, and appeared in the High Court defending a Summary Judgment application.
- Instructed by an English company in a dispute relating to warranties in a share purchase agreement. Adam settled pleadings as a junior to Rebecca Sabben-Clare.
- Instructed by an Irish investor in a dispute relating to the formation of a commercial contract. Adam advised as sole Counsel.
- Instructed by an English individual in a dispute relating to a loan agreement and the ownership of a yacht. Adam advised and settled pleadings as sole Counsel.
- Instructed by a Dutch company in relation to an application under s.79 of the Arbitration Act 1996. Adam advised as sole Counsel.
- Instructed by an English company in a dispute relating to the destruction of property by a bailee. Adam advised as sole Counsel.
- Instructed by an English individual in a dispute relating to the loss of property by a bailee. Adam advised and settled pleadings as sole Counsel.
- Instructed by banks and private individuals to appear as sole Counsel in various County Court hearings.
Insurance and Reinsurance
- Instructed by a Lloyds reinsurer in relation to Exxon/Kuwait-tainted losses. Adam advised as a junior to Jonathan Gaisman QC.
- Instructed by a Liberian company in a dispute relating to actual / constructive total losses under a contract of marine insurance. Adam settled pleadings as a junior to Christopher Butcher QC.
- Instructed by an English company in a dispute relating to liability insurance and the Third Parties (Rights against Insurers) Act 1930. Adam advised as a junior to David Allen QC.
- Instructed by a Lloyds insurer in a dispute relating to misrepresentation and non-disclosure in the context of property and business interruption insurance. As a junior to Richard Waller, Adam advised, settled pleadings, and helped with the preparation of expert evidence.
- Instructed by a foreign state insurance company in a dispute relating to reinsurance treaties. As sole Counsel, Adam prepared an application to the High Court under s.18 of the Arbitration Act 1996.
- Instructed by an English company in a dispute relating to non-disclosure and E&O insurance. Adam advised as sole Counsel.
- Instructed by an English P&I club in relation to subrogation and assignment of rights of suit. Adam advised as sole Counsel.
- Assisted Gavin Kealey QC in a dispute relating to the incorporation of arbitration and choice of law clauses in an insurance contract.
Shipping
- Instructed by an English P&I club in a time charterparty dispute raising issues of contract construction and the proper calculation of damages. Adam advised as a junior to Richard Waller.
- Instructed by an English P&I club in various disputes relating to the running of laytime and demurrage under voyage charterparties. In each case, Adam advised as sole Counsel.
- Instructed by a Singaporean company in a dispute relating to deviation under a voyage charterparty. Adam settled pleadings as sole Counsel.
- Assisted Timothy Brenton QC in a dispute relating to the proper construction of a voyage charterparty and the operation of the Hague-Visby rules.
- Assisted Charles Priday in advising on the liability of yacht owners for the escape of fire from their vessels.
